Gwyneth Paltrow’s skiing collision trial entered its third day on Thursday.

The Hollywood star and Goop CEO has been accused of crashing into Terry Sanderson, 76, on a ski slope at the Deer Valley resort in Park City in February 2016.

Mr Sanderson claims Paltrow slammed into him in a “full body hit” leaving him with “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”. Meanwhile, Paltrow claims it was Ms Sanderson who crashed into her.

On the third day of trial in Park City, Utah, psycho-neurologist Dr Alina Fong hit out at the defence’s claims that Mr Sanderson was exaggerating his symptoms to exploit Ms Paltrow’s celebrity status and wealth. D

Fong, who opened a clinic in Boston in partnership with Tom Brady, has diagnosed Mr Sanderson with PCS (persistent post-concussive symptoms), which she said happened after the accident.

Experts hired by Ms Paltrow have yet to testify, but when asked about their scepticism about Mr Sanderson’s PCS diagnosis, Dr Fong said that she believed she was the only expert who could make that call. Previously, Ms Paltrow’s attorneys said during opening arguments that Mr Sanderson’s claims were “utter BS.”

“There’s a huge difference between going over someone’s chart in another state or across the world and having that patient in front of me crying,” Dr Fong said in a deposition shown to the jury. “I think it’s very easy to criticise someone from far away and it’s totally different when you’re in the trenches with that patient, trying to get them help.”

She added: “They have a lot of opinions and it just shows that they’re not concussion experts, specifically traumatic brain injury experts and If I’m being completely honest, a lot of their opinions are easily refutable by just going online and looking at the CDC’s recommendations for clinicians on how to treat concussions.”

Mr Sanderson is seeking $300,000 from Paltrow while she is seeking $1 in damages and for her legal fees to be covered.

Given that Mr Sanderson’s brain injury has lasted more than 18 months, Dr Boehme said his traumatic brain injury (TBI) would be considered permanent.

Dr Boehme declined to comment on the severity of the TBI given the limited scope of his treatment of Mr Sanderson, but said the fact that he was still exhibiting symptoms when he evaluated him six years after the collision makes the chronic conditions of the injuries clear.

Ms Paltrow’s attorney Steve Owen brought up Mr Sanderson’s many health issues, including hearing loss, insomnia, past prostate cancer and heart issues.

Paltrow’s attorneys have worked to paint Sanderson as a 76-year-old whose decline followed a normal course of ageing rather than resulted from crashing into their celebrity client.

They have not yet called witnesses of their own to testify, but during opening statements previewed for jurors that they plan to call Paltrow’s husband Brad Falchuk and her two children, Moses and Apple.

Actor Gwyneth Paltrow’s day on the slopes in Park City, Utah was cut short seven years ago when she had to take some time to rest after she collided with another person coming down the hill.

She’s now taking part in a civil trial that began on Tuesday (21 March).

As she was climbing the hill on 26 February 2016, another skier slammed into her from behind. She suffered minor injuries, for which she says the man apologized immediately. She adds in her legal filing that she was “shaken and upset”.

According to her, Terry Sanderson, 76, a retired optometrist, said he couldn’t clearly remember what had happened after the “full body hit”.

Dr Fong, who treated Mr Sanderson, said he underwent 32 hours of treatment for weeks in hopes that his brain could recover from the injuries he suffered in the collision with Ms Paltrow.

“The treatment was very intensive .... it was a boot camp,” Dr Fong testified.

“He was very compliant. Every day he had at least one hour of cognitive therapy, speech therapy, occupational therapy, neuromuscular therapy, vision ...and psychotherapy.”

Under questioning by Mr Sanderson’s attorneys, Dr Fong said she had advised Mr Sanderson to travel.

“I encouraged him to try to get back to doing things that he loved,” Dr Fong said. “I did caution him that he should not travel alone because of his memory issues and other problem-solving issues.”

She added: “But I did strongly recommend that he tried getting back to doing things that he loved.”

During opening arguments earlier this week, Ms Paltrow’s attorneys had tried to poke holes in Ms Sanderson’s claims by arguing that his injuries could not be as severe as he alleged if he was able to travel to “more than ten countries” after the 2016 ski collision.

Mr Sanderson was ‘ideal patient,’ expert says

When asked by Mr Sanderson’s attorney if there was any chance she believed he was malingering, Dr Fong said: “None whatsoever.”

Dr Fong described Mr Sanderson as an ideal patient who dutifully dedicated 32 hours of his week to treatment. She said Mr Sanderson’s cognitive skills and family life had been affected and by the time she began treating him, his previous enjoyment of life “was gone.”

“Terry showed up to every appointment on time. He gave his best effort,” Dr Fong testified.

“The treatment that we do is very intensive so it would require Terry to show up on time every morning.”

“He was someone who didn’t want to be sick and was doing everything he could do to improve where he was at.”

Dr Fong testified on Thursday that despite her optimism, there was a huge concern Mr Sanderson’s brain functions would not return to what they were before the accident.

“He worked so hard, he really gave his best effort,” Dr Fong, who has treated Mr Sanderson for six years, said. “We noticed some definite improvements but talking to him now, knowing where he is now, it is clear that he’s still struggling.”

She added: “We’re getting to the point, I mean he is 76, and I worry that some of these issues are longstanding.”

He claims that she struck him so hard that he was knocked out. At a press conference in 2019, he said that moments before the collision, he “heard this just hysterical screaming like … King Kong in the jungle or something”.

He said at the time that he thought the speed at which Ms Paltrow was allegedly coming at him could explain the extent of his injuries. “A little bitty bullet can make a big hole,” he said, according to The Salt Lake Tribune.

At that press conference announcing the lawsuit, Mr Sanderson said he noticed a number of large “slow down” signs as he headed down Bandana run, so he slowed down but still stayed with the flow of other skiers coming down the slope.

“It was just instantaneous,” he said in 2019. “I got hit in my back. ... It felt like it had just drove me forward.”

He said he could remember not being able to control himself as he went down.

“And then that’s all I remember to that point — just out,” he said.

Experts for Mr Sanderson say 2016 ski collision caused current symptoms

Wendell Gibby and Sam Goldstein — a radiologist and neuropsychologist — testified on Wednesday.

Dr Gibby and Dr Goldstein have previously appeared as expert witnesses for Sanderson, who has said he broke ribs and sustained brain damage from the crash. Thus far, attorneys have argued over whether Sanderson’s medical problems stemmed from the crash or were merely a byproduct of ageing.

“In a chronology, looking at all the records and evaluating Mr Sanderson, the one event that would appear to acutely lead to the symptoms he was presenting is this particular accident,” Dr Goldstein said. “The ski accident.”

Both parties blame the other for the collision and claim they were crashed into from behind, relying on a little-known Utah law stipulating that whoever is downhill has the right of way when skiing and snowboarding.

Paltrow’s attorneys have asked Judge Kent Holmberg to enact special restrictions throughout the actor-turned-wellness tycoon’s trial, while she has used a blue notebook to shield her face from view when entering and exiting the courtroom.

Gwyneth Paltrow has appeared in a US court to stand trial in a case in which the Oscar-winning actress is alleged to have collided with skier Terry Sanderson, leaving him unresponsive at the Deer Valley Resort in Utah in 2016.

The attorneys for Paltrow and Mr Sanderson, who is suing her, gave their opening statements in court on Tuesday.

Mr Sanderson’s attorneys said they plan to call Paltrow to the stand to testify on Friday, but could do so earlier in the week depending on the other witnesses’ availability, reported the Associated Press.

Paltrow’s husband, Brad Falchuk, and her two children 18-year-old Apple and 16-year-old Moses are also expected to testify.

The actor’s lawyer Stephen Owens described the members of Paltrow’s family as being a part of her skiing group when the incident took place on 26 February 2016.

“She, Brad, now her husband who you’re going to hear from, her daughter Apple, who you’re going to hear from, Moses, who you’re gonna hear from,” he was quoted as saying by People magazine.

Hollywood actor-turned-lifestyle influencer Gwyneth Paltrow is facing legal action from a man who accused her of colliding with him in a “hit-and-run ski crash” seven years ago.

The incident took place on the slopes of Flagstaff Mountain, part of the Deer Valley Resort near Park City, Utah, on 26 February 2016 when Paltrow and retired optometrist Dr Terry Sanderson collided on a beginner’s course known as the Bandana Run.

Mr Sanderson, 76, subsequently filed for damages in January 2019 and is seeking $300,000 in compensation for the injuries he sustained, prompting Paltrow to file a countersuit in which she asks for a symbolic $1 should she win and for her legal expenses to be covered.

Before the second day of proceedings began on Wednesday, attorneys for the Goop founder argued that her privacy was being disturbed by a camera inside the courtroom pointing directly at her face and paparazzi waiting for her in the parking lot.

Mr Sanderson is arguing that Ms Paltrow is essentially guilty of the accident. In his complaint filed in 2019, he alleges that after the collision, she “got up, turned and skied away, leaving Sanderson stunned, lying in the snow, seriously injured”.

“A Deer Valley ski instructor, who had been training Ms. Paltrow, but who did not see the crash, skied over, saw the injured Sanderson and skied off, falsely accusing Sanderson of having caused the crash,” the complaint states.

Ms Paltrow on the other hand, claims that her instructor did in fact witness the collision.

The rule of the hills in Utah is that those ahead of you have the right of way and that those coming from behind have to avoid others. Both Mr Sanderson and Ms Paltrow claim that they were lower down on the mountain.

Deer Valley adheres to the National Ski Areas Association responsibility code, which also says that all skiers must be in control and able to stop as well as avoid other skiers.

Ms Paltrow says in her pre-trial filing that Mr Sanderson’s injuries are exaggerated because an examination was conducted with his doctor, which didn’t reveal anything lacking in his cognitive functioning, the claim says.

The movie star’s filing states that medical records show that he was diagnosed with a “mild” concussion and that he has spent “extended periods of time” on vacation abroad following the crash.

The counterclaim also alleges that Mr Sanderson had 15 chronic medical problems and that he had told his physician a year previously that he was blind in his right eye, and that the vision in his left eye was getting worse.

“She did not knock him down or cause him to suffer a concussion, brain injury, or broken ribs,” Ms Paltrow’s filing states.

Doctor says man in Gwyneth Paltrow ski accident can’t enjoy wine tasting anymore

Terry Sanderson, a retired optometrist, claims a 2016 ski crash with Gwyneth Paltrow left him with permanent injuries that altered his quality of life.

“Terry had been a high-functioning, active person,” Dr Wendell Gibby, a neuroradiology expert, said of Mr Sanderson’s injuries during testimony on Wednesday. “Every day he was doing lots of things. Meeting groups, wine tasting, skiing, volunteering.”

“After the accident, he deteriorated abruptly and many of the activities he loved to do, he stopped doing,” the expert added.

Ms Paltrow has asserted it was Mr Sanderson who crashed into her.

Doctor describes ‘mind injury’ after ski accident

Neuropsychologist Dr Sam Goldstein says Terry Sanderson, 76, may have suffered from a psychological “mind injury” in addition to a “minor” physical brain injury after allegedly colliding with actor Gwyneth Paltrow on a Utah ski slope in 2016.

“There’s a brain injury and there’s a mind injury,” said the doctor, who consulted with Mr Sanderson after the accident. “The mind injury is more emotional or psychological, in the sense of what his mind chooses to think about those events subsequently in his life and what happened. What I suggested was that at that moment in time, if I could help his mind look at his life a little different, then I think he could function quite a bit better. He could return to doing some of the things he was doing before.”

Doctor says apology wouldn’t be enough after ski crash

A doctor who consulted with retired optometrist Terry Sanderson after his alleged 2016 collision with Gwyneth Paltrow says at this point, an apology from the actor and Goop founder might not be enough.

Dr Sam Goldstein said under cross-examination by the defence that Mr Sanderson had long struggled with the thought that “the person who skied into him lacked remorse or didn’t support him.”

Over time, Mr Sanderson came to worry the crash left him with cognitive function issues, and “his perception of his dysfunction in every day life became a much bigger issue,” the doctor continued.

“If the person who allegedly skied into him apologised, I don’t think it would solve all his problems today,” he added.

Defence brings up Mr Sanderson’s previous ‘anger management’

Ms Paltrow’s attorneys sought to poke holes in Mr Sanderson’s claim that the accident caused him a severe brain injury that changed his behaviour and affected his brain functions.

They argued that records from 2009 state Mr Sanderson had previous anger management and that he “struggled with self-disclosure” before the 2016 collision.

Dr Goldstein says accident caused ‘acute, rapid, downturn'

Dr Goldstein said that Mr Sanderson’s health issues previous to the accident are not the reason he is struggling today with brain functions.

“Mr Sanderson may have had pre-existing issues with his brain, with his mood, with his health,” Dr Goldstein testified. “But there was, based on the record, an acute, adverse change in his behaviour and emotional function.”

He added: “Initially, it appeared to be a consequence of his physical injuries, he was in pain.”

“But over time, it became apparent that it was more than him being disrupted by pain and that were it not for that particular accident, the life he was living in the six months to a year before, would have been the life he continued to be living.”

Ms Paltrow’s attorneys tried to poke holes in Dr Gibby’s testimony, arguing that he hadn’t conducted “exhaustive” exams on Mr Sanderson.

Dr Gibby testified that Mr Sanderson’s shearing injuries could have been caused by the accident, but it was also possible they were there before.

Before the second day of proceedings began in Park City, Utah, on Wednesday, attorneys for the Goop founder argued that her privacy was being disturbed by a camera inside the courtroom pointing directly at her face and paparazzi waiting for her in the parking lot.

During cross-examination by the defence, Dr Gibby said that he was not aware of reports by one of Mr Sanderson’s daughters that he was “verbally abusive” towards her and her mother.

Ms Paltrow’s attorneys said that Mr Sanderson’s daughter Jenny “did not feel love or nurtured” by her father. They also said Jenny noted he is “easily frustrated and quick to anger.”

The remarks come after Dr Gibby testified that Mr Sanderson had developed frustration towards his grandchildren following the accident.

Two of Mr Sanderson’s daughters are expected to testify about his change in personality in recent years, which Mr Sanderson’s attorneys say stems from the 2016 ski collision.

Based on eyewitness Craig Ramon’s account of the events, Dr Gibby says it is unlikely Mr Sanderson plowed into Ms Paltrow.

“What I believe happened was that [Mr Sanderson] was struck from the left side and that forced him into the ground,” Dr Gibby said. “So the combined weight of the two individuals slamming into the ground caused his broken ribs and head injury.”

He continued: “I don’t think it would be plausible that, if he were running into her, he would have broken the ribs on the side of his chest.”

“He would have had his arms extended, he would have protected his leg. He would have had knees, arms, etc, in front of his chest.”

“He might have had other injuries, a broken arm, leg or wrist, something like that.”

“But in terms of a frontal collision, had he run into Ms Paltrow, he wouldn’t have these injuries.”

Mr Sanderson’s attorneys are trying to prove that it was Ms Paltrow who slammed into their client, arguing that the downhill skier always has the right-of-way.

Instead, Ms Paltrow argues that Mr Sanderson rammed into her.

Testifying for the defence, neuro-radiology expert Dr Gibby said the scenario presented by Mr Sanderson’s attorneys was more compatible with the degree of the injuries he experienced — four displaced broken ribs.

“The force of injury of just falling over would not be the same as if you had someone striking you and knocking you over,” Dr Gibby said. “If you have the combined force of two people, that would also increase... his likelihood for injury.”

Dr Gibby said the accident had deeply affected Mr Sanderson. On one occasion after the accident, Mr Gibby said, Mr Sanderson had to call the police to help him find his car in a parking lot.

Expert testifying for Mr Sanderson takes the stand

Neuro Radiology expert Dr Wendell Gibby was called by the defence on Wednesday to take the stand.

Mr Sanderson’s attorneys are hoping to prove that although their client had previous brain injuries, which they’ve said were mere “risk factors,” the collision with Ms Paltrow is to blame for his worsening symptoms in recent years.

The defence argued this morning that Dr Gibby did not review a previous 2009 MRI performed on Mr Sanderson, which they said makes the expert incapable of offering his opinion.

While on the stand, Dr Gibby testified that he ran a series of tests on Mr Sanderson and found the retired doctor had issued with problem-solving exercises.

The jury did not hear Dr Gibby’s testimony. The court will determine if he can offer his opinion without having reviewed the 2009 MRI.

Goop mogul complains of camera presence in courtroom

Mr Owens complained on Wednesday that an Associated Press photographer, the only photojournalist allowed in the courtroom, pointed their camera at his client.

The attorney also told the judge that Ms Paltrow was photographed in the parking lot of the courthouse.

On Tuesday, Mr Owens also raised the issue that the photographer had taken pictures of Ms Paltrow in the foyer, where pictures are not allowed.

The defence argued that an expert hired by Mr Sanderson’s attorneys had not reviewed a pre-accident 2009 MRI showing that he had brain injuries.

Mr Sanderson’s attorneys rebutted that the expert was aware of those injuries and asserted in a previous deposition that Mr Sanderson had been asymptomatic.

The judge questioned the plaintiff’s attorneys on whether the MRI had been made available to the expert.

Mr Sanderson, 76, filed for damages in January 2019 and is seeking $300,000 in compensation for the injuries he sustained, prompting Ms Paltrow to file a countersuit in which she asks for a symbolic $1 should she win and for her legal expenses to be covered.

He had initially filed for $3.1m in damages but the sum was lowered by the judge.

Meanwhile, Ms Paltrow has called the lawsuit “a meritless claim” and “an attempt to exploit her celebrity and wealth”, insisting she “remembers what happened very clearly”.

Gwyneth Paltrow could take stand today

Actor Gwyneth Paltrow could take the stand today to testify in her civil trial over a 2016 ski collision.

The Hollywood star and Goop CEO has been accused of crashing into retired optometrist Terry Sanderson, 76, on a ski slope at the Deer Valley resort in Park City, Utah in February 2016.

Mr Sanderson claims Paltrow slammed into him in a “full body hit” leaving him with “permanent traumatic brain injury, four broken ribs, pain, suffering, loss of enjoyment of life, emotional distress and disfigurement”.

Meanwhile, Paltrow claims that it was Ms Sanderson who crashed into her on the slope.

Paltrow, her now-husband Brad Falchuk and her children Moses, 16, and Apple, 18, are all expected to testify in the case.

The star may be called to the stand by Mr Sanderson’s legal team on Wednesday if other witnesses are unavailable, his attorney said.

Originally, the plan was to call Paltrow on Friday, they said.
